PREAMBLE

前言

The peoples of Europe, in creating an ever closer union among them, are resolved to share a peaceful future based on common values.

在创设一个前所未有的紧密联盟的过程,欧洲人民决意在共同价值上共享一和平的未来。

Conscious of its spiritual and moral heritage, the Union is founded on the indivisible, universal values of human dignity, freedom, equality and solidarity; it is based on the principles of democracy and the rule of law. It places the individual at the heart of its activities, by establishing the citizenship of the Union and by creating an area of freedom, security and justice.

谅察其精神与道德上之传统,欧洲联盟乃建立在不可分离及普世价值之人性尊严、自由、平等与团结之上。其系奠基于民主与法治原则之上。藉由创立欧洲联盟公民并创造一自由、安全与正义之领域,欧洲联盟认为个人是其各项活动之重心。

The Union contributes to the preservation and to the development of these common values while respecting the diversity of the cultures and traditions of the peoples of Europe as well as the national identities of the Member States and the organisation of their public authorities at national, regional and local levels; it seeks to promote balanced and sustainable development and ensures free movement of persons, goods, services and capital, and the freedom of establishment.

欧洲联盟对于上述共同价值之发展与保存有所贡献,但是其亦尊重欧洲人民文化与传统之多元性、各会员国国民之自我意识及国家、区域与地方层级之公权力组织;欧洲联盟欲促进平衡及永续之发展,并确保人员、货物、服务与资金之自由流动与创业自由。

To this end, it is necessary to strengthen the protection of fundamental rights in the light of changes in society, social progress and scientific and technological developments by making those rights more visible in a Charter.

为达成此一目的,且衡酌社会变迁及进步与科技发展之情形,有必要以于一宪章中将彼等权利加以明示之方式,加强对基本权利之保障。

This Charter reaffirms, with due regard for the powers and tasks of the Community and the Union and the principle of subsidiarity, the rights as they result, in particular, from the constitutional traditions and international obligations common to the Member States, the Treaty on European Union, the Community Treaties, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Social Charters adopted by the Community and by the Council of Europe and the

case-law of the Court of Justice of the European Communities and of the European Court of Human Rights.

基于尊重欧洲共同体与欧洲联盟之权力与职掌及辅助原则之前提,本宪章再次确认这些权利,因为这些权利源自于会员国共同之宪政传统与国际义务、欧洲联盟条约、欧洲共同体各条约、欧洲保护人权与基本自由公约、欧洲共同体与欧洲理事会所通过之各社会宪章及欧洲共同体法院与欧洲人权法院之判决。

Enjoyment of these rights entails responsibilities and duties with regard to other persons, to the human community and to future generations.

对于此等权利之享有,伴随着对他人、人类社会以及未来世代之责任与义务。

The Union therefore recognises the rights, freedoms and principles set out hereafter. 欧洲联盟兹此确认以下诸权利、自由与原则。

CHAPTER I (第一章)

DIGNITY (尊严)

Article 1 (第一条)

Human dignity

人性尊严

Human dignity is inviolable. It must be respected and protected.

人性尊严不可侵犯,其必须受尊重与保护。

Article 2 (第二条)

Right to life

生命权

1. Everyone has the right to life.

人人均享有生命权。

2. No one shall be condemned to the death penalty, or executed.

不论何人均不受死刑判决或受死刑执行。

Article 3 (第三条)

Right to the integrity of the person

人身自主权

1. Everyone has the right to respect for his or her physical and mental integrity. 人人均享有尊重其心理与生理自主之权利。

2. In the fields of medicine and biology, the following must be respected in particular: 于医药与生物领域,下列事项应特别受到遵守:

— the free and informed consent of the person concerned, according to the procedures laid down by law,

依法律规定程序之相关人员之自由且经告知之同意;

— the prohibition of eugenic practices, in particular those aiming at the selection of

persons,

禁止基因改造医疗行为,特别是针对人种选择而行之者;

— the prohibition on making the human body and its parts as such a source of financial gain,

禁止为营利而为人体与器官复制;

— the prohibition of the reproductive cloning of human beings.

禁止复制人之行为。

Article 4 (第四条)

Prohibition of torture and inhuman or degrading treatment or punishment

酷刑与不人道或羞辱之待遇或惩罚之禁止

No one shall be subjected to torture or to inhuman or degrading treatment or punishment.

不论何人均不得被施以酷刑或不人道或羞辱之待遇或惩罚

Article 5 (第五条)

Prohibition of slavery and forced labour

奴隶与强制劳动之禁止

1. No one shall be held in slavery or servitude.

不论何人均不得被处为奴隶或奴役。

2. No one shall be required to perform forced or compulsory labour.

不论何人均不得被要求施以强制或非自愿性劳动。

3. Trafficking in human beings is prohibited.

禁止进行人口贩卖。

CHAPTER II (第二章)

FREEDOMS (自由权)

Article 6 (第六条)

Right to liberty and security

自由与安全之权利

Everyone has the right to liberty and security of person.

人人均有权享有人身自由与安全。

Article 7 (第七条)

Respect for private and family life

个人与家庭生活

Everyone has the right to respect for his or her private and family life, home and communications.

人人均有权要求尊重其私人与家庭生活、住居及通信。

Article 8 (第八条)

Protection of personal data

个人信息之保护

1. Everyone has the right to the protection of personal data concerning him or her. 人人均有权享有个人信息之保护。

2. Such data must be processed fairly for specified purposes and on the basis of the consent of the person concerned or some other legitimate basis laid down by law. Everyone has the right of access to data which has been collected concerning him or her, and the right to have it rectified.

此等信息应仅得于特定明确目的,且于信息所有人同意或其它法律规定之正当依据下,公平地被处理。人人均有权了解其个人信息,并有权要求销毁其个人信息。

3. Compliance with these rules shall be subject to control by an independent authority. 应由独立之主管机关监督这些原则之确实遵守。

Article 9 (第九条)

Right to marry and right to found a family

结婚权与组织家庭权

The right to marry and the right to found a family shall be guaranteed in accordance with the national laws governing the exercise of these rights.

结婚权与组织家庭权应依国内法律规定此等权利行使之范围而保障之。

Article 10 (第十条)

Freedom of thought, conscience and religion

思想、良心与宗教自由

1. Everyone has the right to freedom of thought, conscience and religion. This right includes freedom to change religion or belief and freedom, either alone or in community with others and in public or in private, to manifest religion or belief, in worship, teaching, practice and observance.

人人均有权享有思想、良心与宗教之自由。此一权利包括改变宗教或信念之自由,及不论系独自或于社群中,亦不论系公开或私下,于礼拜、教学、职业与仪式中,表达其宗教与信仰之自由。

2. The right to conscientious objection is recognized, in accordance with the national laws governing the exercise of this right.

基于良心而反对之权利应依国内法律行使此一权利之规定而确认之。

Article 11 (第十一条)

Freedom of expression and information

表意与信息自由

1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.

人人均有权享有表意自由。此一权利应包括保有意见之自由,与接收与传递信息及意见,而不受公权力干预与地域之限制。

2. The freedom and pluralism of the media shall be respected.

媒体之自由与多元性应受到尊重。

Article 12 (第十二条)

Freedom of assembly and of association

集会与结社自由

1. Everyone has the right to freedom of peaceful assembly and to freedom of

association at all levels, in particular in political, trade union and civic matters, which implies the right of everyone to form and to join trade unions for the protection of his or her interests.

人人均有权享有和平集会之自由与于各阶层结社之自由,特别是有关政治、工会与私人事务之集会及结社,因其包含每个人为保护自我利益而组成或参加工会之权利。

2. Political parties at Union level contribute to expressing the political will of the citizens of the Union.

欧洲联盟层次之政党团体有助于欧洲联盟公民表达政治意愿。

Article 13 (第十三条)

Freedom of the arts and sciences

艺术与科学自由

The arts and scientific research shall be free of constraint. Academic freedom shall be respected.

艺术与科学研究不应受限制。学术自由应被尊重。

Article 14 (第十四条)

Right to education

受教权

1. Everyone has the right to education and to have access to vocational and continuing training.

人人均享有受教育与接受职业及技职训练之权利。

2. This right includes the possibility to receive free compulsory education. 此一权利包括接受免费义务教育之机会。

3. The freedom to found educational establishments with due respect for democratic principles and the right of parents to ensure the education and teaching of their children in conformity with their religious, philosophical and pedagogical convictions shall be respected, in accordance with the national laws governing the exercise of such freedom and right.

设立尊重民主原则之教育事业之自由与父母确保其子女受符合其信仰、哲学与学术确信而受教育与训练之权利,应依此等自由与权利行使之相关国内法律规定而得到保障。

Article 15 (第十五条)

Freedom to choose an occupation and right to engage in work

职业自由与工作权

1. Everyone has the right to engage in work and to pursue a freely chosen or accepted

occupation.

人人均享有工作与追求自由选择或接受职业之权利。

2. Every citizen of the Union has the freedom to seek employment, to work, to exercise the right of establishment and to provide services in any Member State.

欧洲联盟的每个公民均有权享有于任何会员国受雇、工作、创业与提供服务之自由。

3. Nationals of third countries who are authorised to work in the territories of the Member States are entitled to working conditions equivalent to those of citizens of the Union.

经允许而于会员国境内工作之非会员国国民,有权享有与欧洲联盟公民所享有之相同劳动条件。

Article 16 (第十六条)

Freedom to conduct a business

营业自由

The freedom to conduct a business in accordance with Community law and national laws and practices is recognised.

依欧洲共同体法律与国内法令规定之营业自由应予确认。

Article 17 (第十七条)

Right to property

财产权

1. Everyone has the right to own, use, dispose of and bequeath his or her lawfully acquired possessions. No one may be deprived of his or her possessions, except in the public interest and in the cases and under the conditions provided for by law, subject to fair compensation being paid in good time for their loss. The use of property may be regulated by law in so far as is necessary for the general interest.

人人均享有拥有、使用、处分与遗赠其合法取得财产之权利。除非基于公共利益,符合法律规定之要件及情况,并于合理期间内适当补偿损失,不得剥夺个人财产。法律得于符合公共利益之情况管理个人财产之使用。

2. Intellectual property shall be protected.

智慧财产权应受到保护。

Article 18 (第十八条)

Right to asylum

庇护权

The right to asylum shall be guaranteed with due respect for the rules of the Geneva Convention of 28 July 1951 and the Protocol of 31 January 1967 relating to the status

of refugees and in accordance with the Treaty establishing the European Community. 庇护权应于符合一九五一年七月二十八日日内瓦公约与一九六七年一月三十一日关于难民地位议定书及欧洲共同体条约之相关规范下受到保障。

Article 19 (第十九条)

Protection in the event of removal, expulsion or extradition

移居、驱逐与引渡事件之保护

1. Collective expulsions are prohibited.

集体驱逐应被禁止。

2. No one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment.

任何人均不得被移居、驱逐或引渡至一将使其遭受死刑、酷刑与其它非人道与羞辱待遇与惩罚之严重危险之国家。

CHAPTER III (第三章)

EQUALITY (平等)

Article 20 (第二十条)

Equality before the law

法律上平等

Everyone is equal before the law.

法律之前人人平等。

Article 21

Non-discrimination

不受歧视

1. Any discrimination based on any ground such as sex, race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or sexual orientation shall be prohibited.

任何基于性别、种族、肤色、血源或社会背景、面容外貌、语言、宗教与信念、政治或任何其它意见、少数族裔成员、财产、出生、残障、年龄或性倾向之歧视,均应被禁止。

2. Within the scope of application of the Treaty establishing the European Community and of the Treaty on European Union, and without prejudice to the special provisions of those Treaties, any discrimination on grounds of nationality shall be prohibited. 在适用欧洲共同体条约与欧洲联盟条约的范围内,任何基于国籍之歧视均应被禁止。

Article 22 (第二十二条)

Cultural, religious and linguistic diversity

文化、宗教与语言多元性

The Union shall respect cultural, religious and linguistic diversity.

欧洲联盟应尊重文化、宗教与语言之多样性。

Article 23 (第二十三条)

Equality between men and women

男女平等

Equality between men and women must be ensured in all areas, including employment, work and pay.

男女间于包括雇用、劳动与报酬等所有领域之平等,应受到保障。

The principle of equality shall not prevent the maintenance or adoption of measures providing for specific advantages in favour of the under-represented sex.

平等原则不应影响到为少数性别提供特定利益之措施的施行与采用。

Article 24 (第二十四条)

The rights of the child

儿童权利

1. Children shall have the right to such protection and care as is necessary for their well-being. They may express their views freely. Such views shall be taken into consideration on matters which concern them in accordance with their age and maturity.

儿童享有受必要保护与照顾之权利。儿童得自由地表达其观点,此等观点应于与儿童相关之事务上,依其年龄与成熟度而受到考虑。

2. In all actions relating to children, whether taken by public authorities or private institutions, the child's best interests must be a primary consideration.

所有与儿童相关之行为,不论是由公家机构或私人机构所进行,儿童之最适利益应为首要考虑。

3. Every child shall have the right to maintain on a regular basis a personal relationship and direct contact with both his or her parents, unless that is contrary to his or her interests.

每个儿童均享有于一固定期限内维持个人关系及与双亲直接接触之权利,但其情形违反儿童之利益者不在此限。

Article 25 (第二十五条)

The rights of the elderly

老人权利

The Union recognises and respects the rights of the elderly to lead a life of dignity and independence and to participate in social and cultural life.

欧洲联盟确认并尊重老人享有尊严与独立之生活及参与社会及文化生活之权利。

Article 26 (第二十六条)

Integration of persons with disabilities

残障者之公平待遇

The Union recognises and respects the right of persons with disabilities to benefit from measures designed to ensure their independence, social and occupational

integration and participation in the life of the community.

欧洲联盟确认并尊重残障者享有为了确保其独立、社会与就业公平待遇及参与社群生活之各项措施的权利。

CHAPTER IV (第四章)

SOLIDARITY (团结)

Article 27 (第二十七条)

Workers' right to information and consultation within the undertaking

劳工于工作中获得信息与谘商之权利

Workers or their representatives must, at the appropriate levels, be guaranteed information and consultation in good time in the cases and under the conditions provided for by Community law and national laws and practices.

劳工或其代表就欧洲共同体法律、国内法律与措施所规定之条件与案件上,于适当层级上立即获得数据与谘商之权利,必须受到保障。

Article 28 (第二十八条)

Right of collective bargaining and action

团体协商与行动之权利

Workers and employers, or their respective organisations, have, in accordance with Community law and national laws and practices, the right to negotiate and conclude collective agreements at the appropriate levels and, in cases of conflicts of interest, to take collective action to defend their interests, including strike action.

劳工与雇主或其代表团体,依欧洲共同体法律、国内法律与措施,于适当层级上进行协商及签订团体协议之权利。若于利益冲突时,有采取包括罢工之集体行动,以保护其自我利益之权利。

Article 29 (第二十九条)

Right of access to placement services

获得职业介绍之权利。

Everyone has the right of access to a free placement service.

人人均有获得免费职业介绍之权利。

Article 30 (第三十条)

Protection in the event of unjustified dismissal

不当解雇事件之保护

Every worker has the right to protection against unjustified dismissal, in accordance with Community law and national laws and practices.

劳工有依欧洲共同体法律、国内法律与措施,不受不当解雇之权利。

Fair and just working conditions

公平合理之劳动条件

1. Every worker has the right to working conditions which respect his or her health, safety and dignity.

劳工享有尊重其健康、安全与尊严之劳动条件的权利。

2. Every worker has the right to limitation of maximum working hours, to daily and weekly rest periods and to an annual period of paid leave.

劳工享有最高工时限制、每日与每周休息时间与支薪年休期间之权利。

Article 32 (第三十二条))

Prohibition of child labour and protection of young people at work

童工之禁止与在职青少年之保护。

The employment of children is prohibited. The minimum age of admission to employment may not be lower than the minimum school-leaving age, without prejudice to such rules as may be more favourable to young people and except for limited derogations.

禁止雇用儿童。最低雇用年龄不得低于基本教育年龄,但有利于青少年及特别例外情况不在此限。

Young people admitted to work must have working conditions appropriate to their age and be protected against economic exploitation and any work likely to harm their safety, health or physical, mental, moral or social development or to interfere with their education.

被许可就业之青少年须依适合其年龄之劳动条件,并受保护以免于受经济剥削与从事其它可能伤害其安全、健康或生理、心理、道德或社会发展或妨碍其教育之工作。

Article 33 (第三十三条)

Family and professional life

家庭与职业生活

1. The family shall enjoy legal, economic and social protection.

家庭应享有法律上、经济上与社会上之保护。

2. To reconcile family and professional life, everyone shall have the right to protection from dismissal for a reason connected with maternity and the right to paid maternity leave and to parental leave following the birth or adoption of a child.

为使其家庭与职业生活协调,人人均有受免于因与妊娠有关之理由而受解雇之权利,以及支薪产假与因子女出生或领养而休育婴假之权利。

Social security and social assistance

社会福利与社会救助

1. The Union recognises and respects the entitlement to social security benefits and social services providing protection in cases such as maternity, illness, industrial accidents, dependency or old age, and in the case of loss of employment, in accordance with the rules laid down by Community law and national laws and practices.

欧洲联盟依欧洲共同体法律、国内法律及措施之相关规定,确认并尊重于妊娠、疾病、工业意外、失依或年老及失业情况下提供保护之社会福利利益与社会服务之享有。

2. Everyone residing and moving legally within the European Union is entitled to social security benefits and social advantages in accordance with Community law and national laws and practices.

任何人合法居住或迁移于欧洲联盟境内,有权享有依欧洲共同体法律、国内法律及措施规定之社会安全福利与社会利益。

3. In order to combat social exclusion and poverty, the Union recognises and respects the right to social and housing assistance so as to ensure a decent existence for all those who lack sufficient resources, in accordance with the rules laid down by Community law and national laws and practices.

为消除社会边缘化及贫穷,欧洲联盟确认并尊重依据欧洲共同体法律、国内法律及措施之相关规定之社会与居住补助之权利,以确保所有欠缺适足资源者能享有有尊严之生活。

Article 35 (第三十五条)

Health care

健康照护

Everyone has the right of access to preventive health care and the right to benefit from medical treatment under the conditions established by national laws and practices. A high level of human health protection shall be ensured in the definition and implementation of all Union policies and activities.

人人均享有依国内法律及措施确立之条件下接受预防性健康照护与接受医药治疗之权利。欧洲联盟所有政策与行为之解释与实践,均应确保高水平之人体健康保护。

Article 36 (第三十六条)

Access to services of general economic interest

一般经济利益服务之获得

The Union recognises and respects access to services of general economic interest as

provided for in national laws and practices, in accordance with the Treaty establishing the European Community, in order to promote the social and territorial cohesion of the Union.

欧洲联盟确认并尊重依符合欧洲共同体条约规定之国内法律与措施而获得一般经济利益服务之权利,以便能促进欧洲联盟社会与领域之结合。

Article 37 (第三十七条)

Environmental protection

环境保护

A high level of environmental protection and the improvement of the quality of the environment must be integrated into the policies of the Union and ensured in accordance with the principle of sustainable development.

高标准之环境保护及环境质量改善,必须纳入欧洲联盟之政策并符合永续发展原则。

Article 38 (第三十八条)

Consumer protection

消费者保护

Union policies shall ensure a high level of consumer protection.

欧洲联盟之政策必须保障高标准之消费者保护。

CHAPTER V (第五章)

CITIZENS' RIGHTS (公民权)

Article 39 (第三十九条)

Right to vote and to stand as a candidate at elections to the European Parliament

欧洲议会议员选举与被选举权

1. Every citizen of the Union has the right to vote and to stand as a candidate at elections to the European Parliament in the Member State in which he or she resides, under the same conditions as nationals of that State.

欧洲联盟之每个公民,均享有于与其居住地之会员国国民相同条件下,于该国参与欧洲议会议员之选举及被选举权。

2. Members of the European Parliament shall be elected by direct universal suffrage in a free and secret ballot.

欧洲议会议员应经由普遍、直接、无记名之自由选举方式产生。

Article 40 (第四十条)

Right to vote and to stand as a candidate at municipal elections

地区选举之选举与被选举权

Every citizen of the Union has the right to vote and to stand as a candidate at municipal elections in the Member State in which he or she resides under the same conditions as nationals of that State.

欧洲联盟之每个公民,均享有于与其居住地之会员国国民相同条件下,于该国参与地区选举及被选举权。

Article 41 (第四十一条)

Right to good administration

享受良好行政之权利

1. Every person has the right to have his or her affairs handled impartially, fairly and within a reasonable time by the institutions and bodies of the Union.

人人均享有其事务受到欧洲联盟机构及部门之公正、公平与适时处理之权利

2. This right includes:

此一权利包括:

— the right of every person to be heard, before any individual measure which would affect him or her adversely is taken;

人人均有在受到任何不利益之个别措施前接受通知之权利;

— the right of every person to have access to his or her file, while respecting the legitimate interests of confidentiality and of professional and business secrecy;

人人均有于尊重机密与职业及商业秘密之合法利益下,取得自己所属之个人档案之权利;

— the obligation of the administration to give reasons for its decisions.

行政机关就行政决定应附理由之义务。

3. Every person has the right to have the Community make good any damage caused by its institutions or by its servants in the performance of their duties, in accordance with the general principles common to the laws of the Member States.

人人均有依会员国法律所共同之一般原则要求欧洲共同体就其机构或履行职务之公务员所导致之损害进行补偿或赔偿之权利。

4. Every person may write to the institutions of the Union in one of the languages of the Treaties and must have an answer in the same language.

人人均得以欧洲联盟条约各条约规定之任一种语言文字函询欧洲联盟之机构,并应获得使用相同语言文字之回复。

Article 42 (第四十二条)

Right of access to documents

取得文件之自由。

Any citizen of the Union, and any natural or legal person residing or having its registered office in a Member State, has a right of access to European Parliament, Council and Commission documents.

欧洲联盟公民与于一会员国中居住之自然人或登记营业所之法人,均有取得欧洲议会、部长理事会及执委会文件之权利。

Article 43 (第四十三条)

Ombudsman

监察使

Any citizen of the Union and any natural or legal person residing or having its registered office in a Member State has the right to refer to the Ombudsman of the Union cases of maladministration in the activities of the Community institutions or bodies, with the exception of the Court of Justice and the Court of First Instance acting in their judicial role.

欧洲联盟公民与于一会员国中居住之自然人或登记营业所之法人,均享有就欧洲共同体机构及部门之违法不当行政作为,向欧洲联盟监察使提出申诉之权利,但欧洲法院与初审法院之司法行为不在此限。

Article 44 (第四十四条)

Right to petition

请愿权

Any citizen of the Union and any natural or legal person residing or having its registered office in a Member State has the right to petition the European Parliament. 欧洲联盟公民与于一会员国中居住之自然人或登记营业所之法人,均有向欧洲议会请愿之权利。

Article 45 (第四十五条)

Freedom of movement and of residence

迁徙与居住自由

1. Every citizen of the Union has the right to move and reside freely within the territory of the Member States.

欧洲联盟公民均享有于会员国领域内自由迁徙与居住之权利。

2. Freedom of movement and residence may be granted, in accordance with the Treaty establishing the European Community, to nationals of third countries legally resident in the territory of a Member State.

合法居住于一会员国领域内之非会员国国民,亦得符合欧洲共同体条约之情况下享有迁徙与居住之自由。

Article 46 (第四十六条)

Diplomatic and consular protection

外交领事保护

Every citizen of the Union shall, in the territory of a third country in which the Member State of which he or she is a national is not represented, be entitled to protection by the diplomatic or consular authorities of any Member State, on the same conditions as the nationals of that Member State.

于其母国无外交人员派驻之第三国境内,欧洲联盟公民均享有于该地派驻有外交或领事机构之会员国国民相同之待遇,而受到该会员国外交领事机构保护之权利。

CHAPTER VI (第六章)

JUSTICE (司法)

Article 47 (第四十七条)

Right to an effective remedy and to a fair trial

有效救济与公平审判之权利

Everyone whose rights and freedoms guaranteed by the law of the Union are violated has the right to an effective remedy before a tribunal in compliance with the conditions laid down in this Article.

于欧洲联盟法律所保障之权利与自由受到侵害时,人人均享有符合本条规定之法庭前获得有效救济之权利。

Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law. Everyone shall have the possibility of being advised, defended and represented.

人人均享有于适当合理时间在独立且公正之已依法设立之法庭中获得公平且公开之审理之权利。人人均应有机会获得律师建议、辩护与代理之机会。

Legal aid shall be made available to those who lack sufficient resources in so far as such aid is necessary to ensure effective access to justice.

就欠缺充分适足资源者,应于确保司法程序有效进行之必要范围内,给予司法协助。

Article 48 (第四十八条)

Presumption of innocence and right of defence

无罪推定与辩护权

1. Everyone who has been charged shall be presumed innocent until proved guilty according to law.

被告于依法被证明有罪之前,应被推定为无罪。

2. Respect for the rights of the defence of anyone who has been charged shall be guaranteed.

就被告辩护之权利之尊重,应受到保障。

Article 49 (第四十九条)

Principles of legality and proportionality of criminal offences and penalties

刑事犯罪与刑罚之罪刑法定与比例原则

1. No one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence under national law or international law at the time when it was committed. Nor shall a heavier penalty be imposed than that which was applicable at the time the criminal offence was

committed. If, subsequent to the commission of a criminal offence, the law provides for a lighter penalty, that penalty shall be applicable.

任何人就行为时之国内法律或国际法并不构成犯罪之作为或不作为,不得被科以刑罚。不应处以比行为时更重之刑罚,行为后刑罚减轻时应适用之。

2. This Article shall not prejudice the trial and punishment of any person for any act or omission which, at the time when it was committed, was criminal according to the general principles recognized by the community of nations.

本条规定不影响依行为时国际社会普遍承认之一般法则而构成犯罪之作为或不作为之审判与处罚。

3. The severity of penalties must not be disproportionate to the criminal offence. 刑事刑罚应符合比例原则。

Article 50 (第五十条)

Right not to be tried or punished twice

in criminal proceedings for the same criminal offence

一罪不二罚

No one shall be liable to be tried or punished again in criminal proceedings for an offence for which he or she has already been finally acquitted or convicted within the Union in accordance with the law.

就欧洲联盟境内已依法完成追诉或处罚之犯罪,不得重复受刑事审判或刑罚。

CHAPTER VII (第七章)

GENERAL PROVISIONS (通则)

Article 51 (第五十一条)

Scope

适用范围

1. The provisions of this Charter are addressed to the institutions and bodies of the Union with due regard for the principle of subsidiarity and to the Member States only when they are implementing Union law. They shall therefore respect the rights, observe the principles and promote the application thereof in accordance with their respective powers.

本宪章之各项规定依辅助原则适用于欧洲联盟各机构及部门并适用于各会员国实践欧洲联盟法律时。各机构部门及会员国于相关职权范围内,应尊重此等权利,遵守各项原则,并促进各项规定之适用。

2. This Charter does not establish any new power or task for the Community or the Union, or modify powers and tasks defined by the Treaties.

本宪章并未授与欧洲共同体或欧洲联盟任何新权力或职务,亦未变更欧洲联盟各条约所规定之权力与职务。

Article 52 (第五十二条)

Scope of guaranteed rights

受保障权利之范围

1. Any limitation on the exercise of the rights and freedoms recognised by this Charter must be provided for by law and respect the essence of those rights and freedoms. Subject to the principle of proportionality, limitations may be made only if they are necessary and genuinely meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others.

对本宪章所承认之权利与自由之行使之限制,应以法律定之,并应尊重此等权利与自由之本质。依据比例原则,此等限制唯有于具备必要性,并确实符合欧洲联盟承认之一般权利之目的或保护他人自由权利之必要者,始得为之。

2. Rights recognised by this Charter which are based on the Community Treaties or the Treaty on European Union shall be exercised under the conditions and within the limits defined by those Treaties.

基于欧洲共同体条约或欧洲联盟条约而为本宪章确认之权利,应依欧洲共同体条约及欧洲联盟条约规定之条件与范围而行使之。

3. In so far as this Charter contains rights which correspond to rights guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms, the meaning and scope of those rights shall be the same as those laid down by the said Convention. This provision shall not prevent Union law providing more extensive protection.

就本宪章所保障而亦相应受到「欧洲保护人权与基本权公约」保障之权利,其权利之意义与范围应与该公约规定者相同。本条规定不禁止欧洲联盟法律制定更广泛之保护。

Article 53 (第五十三条)

Nothing in this Charter shall be interpreted as restricting or adversely affecting human rights and fundamental freedoms as recognised, in their respective fields of application, by Union law and international law and by international agreements to which the Union, the Community or all the Member States are party, including the European Convention for the Protection of Human Rights and Fundamental Freedoms, and by the Member States' constitutions.

本宪章不得被解释为在适用范围上有限制或不当影响由欧洲联盟法律、国际法及包括「欧洲保护人权与基本自由公约」等欧洲联盟、欧洲共同体或所有会员国参与之国际协议及会员国宪法所承认之人权及基本自由。

Article 54 (第五十四条)

Prohibition of abuse of rights

禁止权利滥用

Nothing in this Charter shall be interpreted as implying any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms recognised in this Charter or at their limitation to a greater extent than is provided for herein.

本宪章不得被解释为授予任何权利,以参与或从事任何以毁损本宪章承认之权利及自由或超越本宪章所允许之限制范围为目的之活动或行为。
