一、担保合同生效条件是什么?

根据法律规定，已经成立的合同要产生当事人预期的后果，就必须满足法定的生效要件。担保合同的生效要件包括：

1、担保合同的当事人缔约时须有相应的缔约能力;

2、当事人的意思表示真实;

3、担保合同不违反强制性法律规范及社会公共利益;

4、履行约定的或法律规定的手续。

二、担保合同什么情况下是无效的?

担保合同必须合法方才有效。根据有关法律和司法解释规定，下列担保合同无效：

(1)国家机关和以公益为目的的事业单位、社会团体违法提供担保的，

担保合同无效。

(2)董事、高级管理人员违反《公司法》第一百四十九条规定，即违反公司章程的规定，未经股东会、股东大会或者董事会同意，以公司财产为他人提供担保的，担保合同无效。

(3)以法律、法规禁止流通的财产或者不可转让的财产设定担保的，担保合同无效。

2、根据《担保法司法解释》规定，下列情形的对外担保合同无效：

(1)未经国家有关主管部门批准或者登记对外担保的。

(2)未经国家有关主管部门批准或者登记，为境外机构向境内债权人提供担保的。

(3)为外商投资企业注册资本、外商投资企业中的外方投资部分的对外债务提供担保的。

(4)无权经营外汇担保业务的金融机构、无外汇收入的非金融性质的企业法人提供外汇担保的。

(5)主合同变更或者债权人将对外担保合同项下的权利转让，未经担保人同意和国家有关主管部门批准的，担保人不再承担担保责任。但法律、法规另有规定的除外。
